Athletic Solutions Privacy Policy

Athletic Solutions (“Athletic Solutions,” “we,” “us,” or “our”) respects your privacy. This Privacy Policy explains how we collect, use, disclose, and protect personal information when you use:

  • athsolutions.shop;
  • admin.athsolutions.net;
  • Athletic Solutions athlete, school, team, or organization storefronts;
  • Athletic Solutions account, athlete, locker-room, and administrative services;
  • Our communications, customer-support services, and text messaging programs; and
  • Any other website, application, product, or service that links to this Privacy Policy.

Together, these are referred to as the “Services.”

By using the Services, you acknowledge the practices described in this Privacy Policy. If you do not agree with this Privacy Policy, please do not use the Services.

1. Personal Information We Collect

The personal information we collect depends on how you interact with the Services.

Information you provide directly

We may collect information that you provide when you create an account, register as an athlete, make a purchase, manage a storefront, communicate with us, or otherwise use the Services. This may include:

  • Name;
  • Username and password;
  • Email address;
  • Mobile or other telephone number;
  • Billing and shipping address;
  • School, team, sport, position, graduation year, and related affiliation information;
  • Athlete profile information, photographs, social-media handles, jersey information, and storefront preferences;
  • Order, transaction, return, and customer-support information;
  • Marketing and communication preferences;
  • Text messaging consent and opt-out selections;
  • Records showing when, where, and how consent was provided;
  • Content submitted through forms, surveys, reviews, messages, or support requests; and
  • Any other information you choose to provide.

Payment information

Payments may be processed by Shopify, Stripe, PayPal, or other payment-service providers. Those providers may collect payment-card or financial-account information directly from you.

Athletic Solutions generally receives transaction details, payment status, and limited payment information rather than complete payment-card numbers. Payment providers process information according to their own privacy policies and terms.

Information collected automatically

When you visit or use the Services, we and our service providers may automatically collect information such as:

  • IP address;
  • Browser and device type;
  • Operating system;
  • Device identifiers;
  • Language and approximate location;
  • Referring and exit pages;
  • Pages, products, and storefronts viewed;
  • Links and features used;
  • Search terms;
  • Shopping-cart activity;
  • Order and checkout activity;
  • Date and time of access;
  • Session duration;
  • Error, diagnostic, and performance information; and
  • Cookie, pixel, tag, and similar technology data.

We may use cookies, log files, web beacons, pixels, software development kits, and similar technologies to collect this information.

Information from other sources

  • Schools, teams, athletic programs, and organizations;
  • Athletes and authorized locker-room members;
  • Shopify and ecommerce providers;
  • Payment processors;
  • Shipping and fulfillment providers;
  • Authentication and identity providers;
  • Marketing and communication providers;
  • Analytics and advertising providers;
  • Social-media platforms when you connect or interact with them;
  • Referral and affiliate links;
  • Publicly available sources; and
  • Other parties when permitted by law.

2. How We Use Personal Information

We may use personal information to:

  • Provide, maintain, and improve the Services;
  • Create, authenticate, secure, and administer accounts;
  • Verify identities and mobile phone numbers;
  • Create and manage athlete profiles and storefronts;
  • Process orders, payments, returns, refunds, commissions, and payouts;
  • Manufacture, personalize, fulfill, and ship products;
  • Communicate about accounts, orders, storefronts, builds, updates, and support requests;
  • Provide notifications an athlete has requested;
  • Send marketing communications when the recipient has separately consented;
  • Personalize products, content, recommendations, and storefront experiences;
  • Operate athlete, school, team, referral, rewards, and promotional programs;
  • Detect and prevent fraud, abuse, security incidents, and unauthorized activity;
  • Troubleshoot errors and monitor the availability and performance of the Services;
  • Measure engagement and the effectiveness of our Services and communications;
  • Maintain records of consent, suppression, delivery, and other compliance activity;
  • Enforce our agreements and policies;
  • Comply with legal, regulatory, tax, accounting, and reporting obligations;
  • Establish, exercise, or defend legal claims; and
  • Carry out another purpose disclosed to you when the information is collected.

We may combine information collected through different parts of the Services when permitted by law.

3. How We Disclose Personal Information

We may disclose personal information in the following circumstances.

Service providers

We may disclose information to companies that perform services on our behalf, including:

  • Ecommerce and website-hosting providers;
  • Cloud-hosting and data-storage providers;
  • Payment processors;
  • Manufacturers, decorators, and product suppliers;
  • Shipping, delivery, and fulfillment providers;
  • Email and text messaging providers;
  • Customer-support providers;
  • Authentication, security, and fraud-prevention providers;
  • Analytics and performance-monitoring providers;
  • Marketing and advertising providers;
  • Accountants, attorneys, consultants, and other professional advisers.

These providers may use personal information only as permitted by their agreements with us and applicable law.

Schools, teams, organizations, athletes, and authorized users

We may disclose relevant information to a school, team, organization, athlete, or authorized locker-room user when necessary to:

  • Operate or administer an affiliated storefront;
  • Manage products or licensed content;
  • Attribute sales or referrals;
  • Calculate commissions or payouts;
  • Provide account access requested by an athlete; or
  • Support the applicable athlete, school, team, or organization program.

We limit this disclosure to information reasonably necessary for the applicable purpose.

Business transfers

We may disclose information in connection with an actual or proposed merger, acquisition, financing, restructuring, sale of assets, bankruptcy, or similar business transaction.

Legal and safety purposes

We may disclose information when we reasonably believe it is necessary to:

  • Comply with applicable law, regulation, legal process, or governmental request;
  • Protect the rights, property, or safety of Athletic Solutions, our users, or others;
  • Investigate fraud, abuse, security incidents, or violations of our policies;
  • Enforce our contracts and other legal rights; or
  • Establish, exercise, or defend legal claims.

With your direction or consent

We may disclose information when you ask us to do so or provide consent for a specific disclosure.

4. SMS and Mobile Information

When you provide a mobile phone number or interact with an Athletic Solutions text messaging program, we may collect:

  • Your mobile phone number;
  • Phone-verification status;
  • The text messaging categories you selected;
  • The date, time, source, and version of the disclosure associated with your consent;
  • Opt-in, opt-out, and suppression status;
  • Text message delivery status;
  • Messaging provider identifiers and error codes; and
  • Limited technical information needed to operate, secure, and audit the program.

We use mobile information to:

  • Send a one-time phone-verification code when requested;
  • Verify possession of a mobile phone number;
  • Send athlete store and account notifications when separately requested;
  • Send promotional or marketing texts when separately requested;
  • Deliver, schedule, and monitor text messages;
  • Honor STOP, START, HELP, and other supported requests;
  • Prevent unwanted, fraudulent, or abusive messaging;
  • Maintain evidence of consent and opt-out activity; and
  • Comply with legal, carrier, and messaging-provider requirements.

Mobile-information non-sharing

Athletic Solutions does not sell, rent, or share mobile phone numbers, text messaging originator opt-in data, or SMS consent with third parties, affiliates, or lead generators for their own marketing or promotional purposes.

We may disclose mobile information to service providers—including messaging platforms, telecommunications carriers, and vendors acting on our behalf—solely as necessary to verify phone numbers, deliver and operate our messaging programs, maintain security, and comply with law. These providers are not authorized to use mobile opt-in information for their own marketing or promotional purposes.

The preceding limitation applies regardless of other provisions in this Privacy Policy concerning disclosure of personal information.

Athlete SMS programs

Athletic Solutions may offer athletes two separately selectable text messaging categories:

  1. Athlete Notifications: Recurring automated store and account notification texts, including completed store-build and store-update notifications.
  2. Athlete Marketing: Recurring automated promotional, product, deal, and marketing texts.

Athletes must separately select each category after verifying their mobile phone number. Selecting one category does not enroll an athlete in the other.

Marketing consent is optional and is not a condition of creating an account, using Athletic Solutions services, or making a purchase.

Requesting a one-time phone-verification code does not enroll the recipient in recurring notification or marketing messages.

Frequency, charges, and opting out

Message frequency varies by program. Message and data rates may apply.

Reply STOP to unsubscribe the mobile number from all Athletic Solutions athlete text messaging categories. Athletes may also disable notification or marketing categories separately through their account settings.

After a global STOP request, replying START re-enables delivery only according to the category preferences previously selected in the athlete’s account. START does not enroll an athlete in a category that the athlete never selected.

Wireless carriers are not liable for delayed or undelivered messages.

5. Cookies and Similar Technologies

We and our service providers may use cookies and similar technologies to:

  • Keep accounts and sessions secure;
  • Remember preferences;
  • Maintain shopping carts;
  • Process checkout activity;
  • Understand how the Services are used;
  • Diagnose errors and improve performance;
  • Measure communications and campaigns;
  • Prevent fraud and abuse; and
  • Provide or measure advertising where permitted.

Some cookies are necessary for the Services to function. Others may be used for analytics, personalization, or advertising.

You may be able to control cookies through your browser or device settings. Blocking certain cookies may prevent parts of the Services from working correctly.

Third-party analytics or advertising providers may collect information subject to their own privacy policies. Where required by applicable law, we will provide additional notice or choices concerning nonessential cookies and targeted advertising.

6. Data Retention

We retain personal information for as long as reasonably necessary to:

  • Provide the Services;
  • Maintain an account or business relationship;
  • Complete transactions;
  • Operate storefronts and athlete programs;
  • Honor communication preferences and suppression requests;
  • Maintain evidence of consent;
  • Prevent fraud and abuse;
  • Resolve disputes;
  • Enforce agreements; and
  • Satisfy legal, tax, accounting, regulatory, and reporting obligations.

Retention periods vary based on the type of information and why it was collected.

We may retain text messaging consent and opt-out records after an account is closed or a recipient unsubscribes when reasonably necessary to demonstrate compliance and prevent unwanted messages.

When information is no longer required, we may delete, de-identify, or aggregate it, subject to applicable law and our technical capabilities.

7. Data Security

We use administrative, technical, and physical safeguards designed to protect personal information.

No method of transmission or storage is completely secure. We cannot guarantee that personal information will never be accessed, used, disclosed, altered, or destroyed without authorization.

You are responsible for maintaining the confidentiality of your account credentials and for notifying us if you believe your account has been compromised.

8. Your Choices

Account information

You may review or update certain account information through your account settings. You may also contact us to request assistance.

Changing a mobile phone number may invalidate its verified status and existing text messaging preferences. The new number must be verified, and recurring message categories must be selected again where required.

Email communications

You may unsubscribe from promotional emails using the unsubscribe link in the message. We may continue sending non-promotional communications concerning an account, order, transaction, security issue, or other service-related matter.

Text messages

You may opt out of athlete text messages by replying STOP. You may also disable individual notification or marketing categories through your account settings.

Opting out of text messages does not automatically unsubscribe you from email communications, and unsubscribing from email does not automatically opt you out of text messages.

Cookies and advertising

You may control certain cookies through your browser, device, or any cookie-preference tools we make available. You may also use opt-out tools provided by participating advertising organizations.

9. Privacy Rights

Depending on where you live, you may have rights concerning your personal information, including the right to:

  • Request access to personal information;
  • Request correction of inaccurate information;
  • Request deletion;
  • Obtain a portable copy of certain information;
  • Request information about categories of information collected or disclosed;
  • Opt out of certain targeted advertising, sales, or sharing as defined by applicable law;
  • Restrict or object to certain processing; and
  • Appeal a decision concerning a privacy request.

These rights are subject to exceptions and limitations under applicable law.

We may need to verify your identity before completing a request. An authorized agent may submit a request where permitted by law, but we may require evidence of the agent’s authority and verification of the consumer’s identity.

We will not unlawfully discriminate against you for exercising an applicable privacy right.

10. Children and Minor Athletes

The general shopping Services are not directed to children under 13, and we do not knowingly collect personal information directly from children under 13 without authorization permitted by law.

Some athlete programs may include users who have not reached the age of majority in their jurisdiction. Minor athletes should use the Services only with the involvement and permission of a parent or legal guardian and in accordance with applicable school, team, organization, and legal requirements.

Parents or legal guardians who believe a child provided personal information without appropriate authorization may contact us at support@athsolutions.net.

Athletic Solutions may impose additional age, parental-consent, or eligibility requirements for particular features, including promotional text messaging.

11. International Users

Athletic Solutions is based in the United States. If you access the Services from another country, your personal information may be transferred to, stored in, and processed in the United States or another jurisdiction where our service providers operate.

Privacy and data-protection laws in those jurisdictions may differ from the laws where you live. Where required, we use appropriate safeguards for international transfers.

The athlete SMS program described above is currently intended for United States mobile numbers and English-language messages.

12. Third-Party Websites and Services

The Services may contain links to websites, applications, social-media platforms, payment providers, or other services operated by third parties.

This Privacy Policy does not govern third-party services. We encourage you to review their privacy policies before providing personal information.

13. Changes to This Privacy Policy

We may update this Privacy Policy to reflect changes to our practices, technologies, Services, or legal obligations.

When we make changes, we will update the effective date above. We may provide additional notice when required by law or when changes are material.

Your continued use of the Services after an updated Privacy Policy becomes effective means that you acknowledge the revised policy. Where required, we will obtain new consent rather than relying on continued use.
